Joebender.com Complaint - Product Not Received/No Refund

SOQUEL, CALIFORNIA -- On 11/9/09 I submitted an order to joebender.com for $36.80 for products. I have proof of payment. Shipment never arrived. I contacted joe@joebender.com and their return email said their server went down and they lost orders. I asked for a refund, since I purchased product somewhere else. I keep emailing asking for refund. The latest return email from them and reason for delay is that the "owner died." It's been nearly 4 months and their website is still active!

I have the email string. I bought this product for a workplace team-building exercise and will not be reimbursed by my company.
