Wal-Mart Complaint - wrongful terminated, retaliation overlooked
With in The last year is when all my troubles started. There is a group of young friends all
working together on the night shift. This group of friends like to gossip and start trouble to
make life more interesting for them. You know high school kids stuff. About 7 months ago
Jared made a comment to me that I didn't like. I went to the night manager, Jason to
complain. Jared got a "D" day because of it. A week later Jared, in his attempt to get
retaliation got all his friends to complain about comments that I have said in conversations
months ago. Comments that was never an issue until Jared got in trouble. Unfortantly
although I had no prier active couchings I got a "D" day. Which I felt was unfare. I talked
to management about that I felt this was obviously retaliation. Nothing was done about it.
I mentioned that I felt I was working in a hostile invirement and wanted to move to another
area but I was told I couldn't because of my couching, "just to stick it out until things
cool off. So I just kept to myself as best as I could even though I had to work in the same
departments as some of the group members.
Recently, I was walking to the breakroom. A couple from the group I mentioned above was
walking slow in front of me. The boyfriend was rubbing his girlfriends lower back upper butt like always on the clock. At some point as I walked around them to open the door for them, I accidently touched the middle of her back. She didn't even know I touched her. The boyfriend saw me and asked what I was doing. I thought nothing of it. I was being courteous as always.
The next day I was called into the office for questioning. Even before I was questioned
rumors had started that I was going to be fired. The couple was telling everyone that they
were going to get me fired. I was off work for the next 2 days but when I came back to work
I was called into the office and terminated. A few days later I was told by a member of
management that the investigation was still ongoing even after I was fired. I had 2 witnesses
that saw that I did nothing wrong. I feel they should have completed the investagation before
fireing me. I was fired on Sept. 14, 2004 and feel management wanted to get rid of me before
Sept. 16. That would have marked the 6 month from my "D" day. This was truely a quick
to judgement situation. Walmart does not fallow the coaching process. 1. verbal 2. written coaching 3. D day 4. fired. In my case they took the word of a young 21 year old that has only worked there for little over a year rather then listening to me mid 30's over 9 year employee. Where is the justice in that? I am using the open door policy and went to the DM but not I went straight to the top to try and get my job back. I plan on going after the kid that got me fired in court for slander and pergery.
