Misty Electronics Complaint - Poor Service - Danger Sidekick Cell Phone

I purchased 3 TMobile Danger Sidekicks from Misty Electronics. They arrived in a timely fashion. Two phones would not power up. One of the two was missing half of the face plate by the camera. I emailed them and they responded quickly. Steve, their responder, advised me that they would be happy to send me two new phones once I sent the non working phones back to him. I am agreeable to this but they he wanted me to pay the freight to send the non working phones back to them. He cited company policy, which is not on the order form. How can you send a person the wrong or broken product and then expect them to pay the cost of the freight back? I find this a deplorable way to conduct business and would not recommend them to anybody. The product was not as described and then cost me even more money to get the product that I originally purchased-working phones.

Is there anyway to just cancel the order, cancel the charge on your credit card and send them the phones back "postage due?" (that is what I would do)
