Birdys.com Complaint - Beware of Birdys.com misleading business practices

A word of advice: Please do not buy anything from Birdys.com. They are out to cheat people in any way by their misleading online sales. They also seem to be doing business in other names (pricebreak.com etc, you can find them on whois search).

I was searching for a Garmin GPS online and I found some good prices at Microsoft Bing web site. One of the vendors listed was Birdys.com. They offered a "New" Garmin GPS 765T for 189.99 with about 5% cash back from Bing. I figured it was a good deal because other sites were offering new ones for $20 or $30 more than this price.

I went ahead and bought the unit and it arrived 2 days later. When I opened the package, I noticed the "refurbished" label on it. To make things worse, it looked really bad (dusty, seemed like it was lying on the road...). I was surprised because the Bidry's listing on Bing had clearly marked it as "New" (I have a print of the web page). I would have never bought a refurbished item for this price and never on an unknown web site like this one. Since there are so many stolen GPSs out their, who knows where these people are getting them from...

Anyways, I called Birdys.com number listed on their web site. After a long wait, the lady who came online said that the "Bing site information was wrong" and that it is not Birdys' responsibility. She said that "I should have called" Birdys if I had any doubt. Why would I doubt that the vendor would blatantly lie in their listing online? Now I know, little birdy lies!! She said that if I return the item, they will charge the restocking fees and also take the initial shipping charge (initial shipping to me was 'free'). Also, I need to send the device back to them at my expense.

In short, I need to take the hit because Birdys screwed up their listing on Bing and they are not even apologetic about their mistake. Once I saw the bad behavior, I started doing some google searches and found that birdys is doing business in various other names to hide from the customer complaints. (called pricebreak.com, birdys.com). See here for more such stories.

Based on other user comments, I know I have a long hard fight ahead to get this company to do a full refund. I am contacting my ccard company already and have filed a complaint with them. You will be better off taking your business to better vendors.

You bought a new item but got a used one; call your credit card company and dispute the charge. Tell them you want the charge reversed and that you are returning the item. They should stick up for you.
