Fletcher Jones Imports, Las Vegas Nevada 89117 Complaint - Failure to honor winning E-Bay bid.

LAS VEGAS, NEVADA -- On Sunday morning, 4/17/2010, I placed a bid of $47,101 with E-snipe for a 2010 Mercedes E550 on E-Bay from Fletcher Jones Imports of Las Vegas. The starting bid on the vehicle was. $57,000 and the"buy it now" price was $58,995. Later in the day at 12:38PM, I received notices from E-snipe and E-Bay that the auction was over and I did not meet the reserve price.

The next morning, Monday, 4/18/10 I received an E-mail from the internet and fleet manager of Fletcher Jones imports stating"Congratulations. You are the high bidder on E-bay for the pre-owned 2010 E550, stock number 8485EX, VIN#WDDHF.... Your bid of $58,101 is the winning bid." He went on to discuss payment, etc. Needless to say, I was thrilled and called him. He congratulated me and I asked if I could call him around 4:30PM as I was at work and it would be easier for me to talk later when I was home. He said that would be fine.

When I returned home, I was greeted by a voice mail that said a terrible mistake had been made and the car was sold to someone else earlier and the dealership could not honor my winning bid. I then tried to call the salesman and he would not answer.

I finally reached an executive who was very apologetic and offered to make things right by offering me another car at a "special price". Her offer of a "special price" was not acceptable to me and I declined.

Bottom line. I do NOT have the car that I won.

I have a hard copies of all documents described as well as a recording of the voice mail left by the salesman,.

I don't understand if you bid $47,101, why did they congratulate you on bidding $58,101? Also, you said the bid didn't meet the reserve so you technically didn't have a winning bid at all.
Maybe they sold the car at the same time a manager was adjusting their reserve on the car for you and one hand didn't know what the other was doing at the time.

My mistakes. I bid $57101 and was awaqrded the bid at $57,000. Why, I don't know...........
