Office Depot Inc Complaint - OFFICE DEPOT NEVER HAS WHAT IT ADVERTISES-OLD BAIT AND SWITCH - DIGITAL PRISM ATSC 710 7 INCH LCD PORTABLE TV

DIGITAL PRISM ATSC 710 7 INCH LCD PORTABLE TV - Complaint
Review by LucasBuck on 2010-05-05
On Sunday, May 2, 2010, I saw the ad in our Houston Chronicle for Office Depot. On the front page was the DIGITAL PRISM ATSC 7 INCH LCD PORTABLE TV, for $ 39.99. Regulary $ 79.99. Making it a half off sale. A great deal, since we have a lot of hurricanes down here, we needed some of these TV's. I checked their website and saw that they opened at 10: 00 A.M. I arrived before 10 A M and found them closed. The door said it opened at 11:00 A.M. I waited and waited. It opened at about 11:05 A. M.. I was first in line, but let an older lady in first. I went straight to the cash register area where there was one of the Office Depot associates. I showed him the ad and asked him where the 7 in portable TV's were at. He told me they had none. He check their computer and said it showed they had none. The manager, Nick, said one of the other stores had 3 and he would call and have them hold them for me. He called the store and they told him, basically, tuff luck. They could not hold them. Nick told me that I could try driving to the other store and hopefully beat other customers too them. The other store had just opened too and the 20 minute trip would have been for nothing. Nick said he had no idea if they would get any in. To me this is just a bait and switch. get you into the store, andyou will probably find something to buy.

A lot of store sale advertisements will have fine print statements in their ads saying "Limited Quantity", "While Supplies Last", "Not Available at All Locations", etc. It's obnoxious, but fulfills legal requirements.

NOT bait and switch. It would only be bait and switch if Office Depot did not send any to ANY of their stores, and intended to deceive. They did not intend to deceive, they just didn't have any! Ads are made months in advance and sometimes quantities don't match right when the ad breaks. They should get some in sometime this week.

It's not uncommon for a store to not hold a sale item. We do the same thing with the company I work for. Because it's a sale item, we won't hold them. It's first come, first served. There have been many times that we have had items on sale but none on-hand in the store. Often, we are able to order them for customers in-store, though.

Yt is right. It's not a bait and switch if they had them available at another store.
