Toro LX425 Complaint - Defective mower - Blown engine

We purchased a Toro LX425 7/07 from Home Depot and an extended warranty. My husband faithfully checked the oil before starting the mower. A rod went through the engine and we were thrilled that we purchased an extended warranty. The extended warranty company said we ran the mower without oil and therefore the extended warranty will not pay for the repairs. We are having the mower analyzed at our own expense by a service company to determine why the engine went - with this info hopefully we will be able to prove to the extended warranty company that the engine was defective. I will never buy an extended warranty again - they are totally worthless.
