Fillmore Center Apartments - San Francisco, CA Complaint - Rental Contract Breach by Fillmore Center Apartments
Resolution Update on 07/06/2010:
Issue amiably resolved.
SAN FRANCISCO CA, CALIFORNIA -- We moved into an apartment for a short term lease and it was not move in ready. We came to see the apartment the day before and was told we couldn't see it because it was being cleaned/repaired, etc. However, upon move-in we were given a form which we were told to complete within 7 days (Check-in/Check-out)and there were a number of discrepancies i.e. the microwave was broken and had to be replaced; the heating system doesn't work properly - there is only two settings - very hot and steamy or cold; the blinds to the balcony have been falling two at a time for the last three weeks - leaving us with no privacy for long periods between time maintenance could come and replace the fallen blind slats; the sink in the bathroom is cracked. The other issue is that we are senior citizens and there are BMR apartments which we weren't told about so we are paying $1745 for a studio apartment where others are paying much less. We asked to move out on the bases that Filmore Apts breached the contract but we were told we couldn't break the contract without paying a two month penalty and they couldn't break the contract by reducing our rent because that would be illegal. We have two more months with which to put up with the conditions and over charging of rent plus we were given a check out list of charges which could be charged against our deposit. Fillmore center is discriminating against us in this matter.
