Carls Jr Complaint - Children Labor Laws And Rights

Review by my son on 2010-07-15
COTTONWOOD, ARIZONA -- My son got hired at the Carls Jr in Cottonwood az... He has worked 3 weeks with one day off....They work the kids 6-8 hours a day with no breaks, and they even tell the youth that works there that to be a part of the team they have to at times work off the clock to prove they are part of the team! Whats wrong with this picture? My son has worked a total of 6 weeks.... Received one check with shorted hour with no explanation... What kind of rights do these kids have when they are treated in such a way. When a manager was confronted they informed, they were not sure of the laws, but didn't care cause the kids should be happy they even get to work!!!!! This is just my first step, the labor board is next!!!!

How old is your son? I'm assuming that because you're expressing your concern regarding his working hours that he is under 18. By law they are only allowed to work a certain number of hours during the week. If it's summer break, it might be different, I'm not sure. If he's over 18 then the laws are different. No matter how old he is, forcing employees to work off the clock and shorting them hours on their paycheck is not acceptable and the employer should be reported. Just a word of advice on that though; if your son is 18 or older, I recommend that you make him file the complaint. If you do it yourself, they might not take you as seriously.

OK, I actually live in Cottonwood...I remember some kids in there cussing up a storm saying mom and dad said it was f'ing illegal to work without a break. If you read the law--it is NOT illegal. Yea, teach your kids to quit, rather than work hard.....

According to this AZ website, no laws are being broken. The site also says there are NO break rules

Employers who employ minors less than 16 years of age are subject to strict limits for hours
worked per day and per week for their minor employees:
1. When school is in session, children 14 and 15 years of age may NOT work:
 During school hours, unless employment is part of a vocational training program;
 More than 3 hours per day, and
 More than 18 hours per week.
2. When school is NOT in session (including summer vacations and holidays), children
under the age of 16 may NOT work.
 More than 8 hours per day; nor
 More than 40 hours per week.
3. Daily hours of work may not be before 7:00 AM or after 7:00 PM except between June
1st and Labor Day when working hours may be extended to 9:00 PM.
Arizona has no restrictions on work hours for minors 16 and 17 years of age

No offense, but you better let your son fight his own battles. By "taking up" for him you are setting him up for failure. Life ain't always feel good and kids need to know that.
