Progressive Auto Insurance Complaint - Appalling Service - Auto Insurance

My son was hit by a 2009 Jaguar insured by Progressive. But it gets better-the guy was DWI and ended up arrested. My son's car was his dream car of only two months. He saved forever for it and now it is totaled. To replace the car would take around $9000. We've looked for comparable cars on many websites and that's the going rate. Progressive repeatedly refuses to talk to me, the holder of the policy, preferring to harass my 21 year old son whose car is now totaled. They gave him a rental for four days, I guess to try and force him to accept the offer. They do not call back promptly, they do not return calls on a timely basis and now there is the very real possibility that my son will lose his job because he cannot get to work and he cannot afford to buy a new car. It would seem since it was THEIR client who was DRUNK at 6:30 in the evening and driving in north Dallas that hit not one but TWO CARS, that Progressive should just cough up the money. This is why people hire lawyers and why lawyers get rich.

Just a note-people can ASK whatever they want for a car-sales ads don't really reflect the true value of the vehicle.

It doesn't matter what insurance company you have. They don't pay you enough to get a comparable vehicle. All they pay is what your current vehicle is worth. Often it is not enough to get another vehicle like the one that was lost.

Sounds like you might have a case with the drunk driver as well.

redmx3racer makes a good point. Asking prices and selling prices are not the same thing.

My wife and I have been through this a couple of times. They will offer you a low-ball figure and hope you'll take it and go away. You have to negotiate and they won't make it easy.

The fact that the offending driver was arrested and, I assume, found guilty helps your cause but you aren't entitled to anything more than fair compensation for the car.

You do have a case with the drunk driver but the driver's liability is insured by Progressive. So, Progressive pays, not the driver.

Your son is the owner of the vehicle and is 21 years old. They cannot speak to you unless he tells them to.
If he disagrees with their evaluation, he should get a copy of it from them and find out where they are finding comparable vehicles for what they are offering.

I understand the difference between asking price and actual price. But they aren't even offering KBB pricing. And, in addition, they are basing their price on what their mechanic says the value is and my understanding is that any repair or accident does not hinge on the mechanic directed by the insurance company in question. My biggest gripe is that they seem to be deliberately lowballing the offer despite the fact that prevailing prices for the same car is twice as much. Regardless of the insurance, they took fault for the accident and as a result have significantly reduced my son's ability to work. Sorry, I don't buy the whole "they don't have to..." arguement. The drunk was driving a 2009 Jag. He's a stockbroker, I looked him up. In short, he will pay one way or another. What sad is that we aren't asking for a new car or even one better than what my son had-we are asking for the same used car. This is why lawyers get rich.
