Herb Chambers Hyundai Auburn MA Complaint - Buyer Beware Hyundai Not Honoring 5 Year 60,000 Bumper to Bumper Warranty
AUBURN, MASSACHUSETTS -- I brought my 2007 Hyundai Sonata to be serviced at Herb Chambers Hyundai Auburn for a knocking in my engine with copies of 14 oil change service receipt which your dealership requested. I expressed to the service tech Mr. C that my 2007 Hyundai Sonata was purchased on Feb 19, 2008 from their Herb Chambers Hyundai Auburn MA Dealership. I also expressed that the 2007 Hyundai Sonata was still covered under warranty from their dealership for 5 years or 60,000 miles. I gave the current mileage on the vehicle of 56,000 which proves the vehicle is still under warranty with their dealership. I then left my 2007 Hyundai Sonata to be serviced under warranty with Herb Chambers Hyundai Auburn MA.
I under good faith with the dealership purchased a 2007 Hyundai Sonata from Herb Chambers Hyundai Auburn MA. On Feb. 19, 2008. The vehicle purchased came with a manufacturer’s bumper to bumper warranty of 5 years or 60,000 miles. On 10/19/2010 I brought my 2007 Hyundai Sonata for warranty servicing at Herb Chambers Hyundai Auburn. I was received a return call on 10/20/2010 from the service manager Mr. P which expressed that the damage with my 2007 Hyundai Sonata was as follows:
1) Inside of the Crank Shaft is scored
2) Bearings inside the crank shaft were damaged
The service manager Mr. P then proceeded to tell me that all 14 of my servicing receipts were faxed over to the Hyundai warranty office and he received a return call from the UPSM stating that they were not covering the servicing or repairs needed under the vehicle warranty due to 11 of my 14 receipts were not considered by the UPSM as proper servicing to my vehicle because the receipts were hand written on the business carbon receipt forms and not printed out by a computer based form. Mr. P also expressed that he had taken pictures of the damaged and faxed them to Hyundai warranty USPM. Mr. P stated that when he received the return call from USPM, they expressed that they felt the vehicle damage was caused by lack of maintenance due to not excepting the 11 other receipts of service. Therefore the vehicle was not being covered by the warranty.
As a result of this unfair or deceptive act or practice, I suffered injury or loss of money as follows:
I purchased a 2007 Hyundai Sonata on Feb 19,2007 for the purchase price of 13443.69 from Herb Chamber Hyundai 735 Southbridge Street Auburn Ma.01501 and because of the manufacturer not honoring their warranty on the vehicle I am left with the 2007 Hyundai Sonata that is un-drivable due to engine defect that is not being repaired under the service warranty.
