Purchased original contract with Saxon Mortgage for 259,000.00. We have been paying our mortgage and other bills on time until the economy went bad in 2009. My wife and I were both laid off. My wife was laid off in 2008 and I got laid off in 2009.
I had met a guy claim that he is “Loan Modification Specialist” at a friend’s birthday party. He told me he could help me with loan modification for a fee of $2,995.00.
At the time I was desperate and wanted to keep my house. He told us to stopped paying our monthly mortgage, so I did starting roughly February 2009. We signed a Service Agreement with Hap Mortgage ( the firm that fraud us ) on March 31st,2009.
Hap Mortgage would negotiate a “loan modification” with Saxon Mortgage for us. On April 4th, we issued a check to Hap Mortgage for $995.00 to start the negotiation. We continue not to pay our mortgage. Sometime in June we had got news from Hap Mortgage that we got approved for a home modification. We paid an additional of $2,000.00. Our 1st trial period on the modification was due on July 1st, 2009.
At the time the Hap Mortgage representative that we work with told us that we would be 100 percent guaranteed back money if we were denied. He told us that the modification is 99 percent that it would be approved. Our original house payment was for $1,887.00 not including property tax and home insurance. The modification would be for $1,123.00 including property tax and home insurance. The new contract would be 2 percent for five years then 5 percent after five years. We continue paying our trial period for roughly 9 month, which is longer than expected. On March 2010, we had received a letter from Saxon Mortgage that our loan had been sold to Ocwen Mortgage meaning we got denied for our modification from Saxon Mortgage. The trial period took too long. Hap Mortgage did nothing to call us or check on the status on the trial period from Saxon Mortgage.
After getting the denied letter I called Hap Mortgage and the guy we work with had been fired because he did not do his job. I then went in the office and talk to the manager of the company. My wife and I wanted to get our refund back for the failed service. After talking it over, we decided to let Hap Mortgage continue to negotiate with the new lender ( Ocwen ). At the time, we had asked for our full refund, the manager Pholy Hap told us that he could only give us $1,000.00 back because they had spent our money. We gave him a second try with the new lender. He wanted us to pay the forbearance of $1,100.00 to Ocwen. I told him no, that I wanted a trial period or I’m not paying Owen any more money that I’ve already lost.
Hap Mortgage hardly seem to care about us because they got our money already. For over a year, Hap Mortgage did not even call once to check up on us. The only way something was done was when I called him ( Pholy Hap) before he took any action with the lender. I felt betrayal and lost. I felt very mad that this firm new exactly we weren’t going to get approved. On October 4th, we got a posted letter of Default to Foreclosure on our house. Very mad, I called Pholy Hap numerous time and he don’t answered. I sent him a priority mail on October 4th so he can fax documents to Ocwen. Again I called him and no answer. His phone message was full and the office did not pick up my phone call. Very mad I went to the office on October 8th and talk to him in person. My wife and I decided to stop doing business with Hap Mortgage. I told him about the letter of default, he reacted like he knew that the day was coming.
While at Hap Mortgage office, he did not even had open my letter of documents. I took it from him. I asked him why he didn’t open my letter; he said, “ You are not George Bush”. I was calmed. While at the office one of his employee was watching a movie on his laptop at his cubicle. How can this be a business with that kind of behavior? At the end of our short conversation, I told him we were done and wanted our money back.
I paid $2,995.00 fee, my hard earn money for a failed service. I am sure that this firm, Hap Mortgage is continually taking advantage of other people like me. Someone have to stop this firm from taking money from our labor hard earn money.
How would you feel if you threw away $2,995 away for a service that was just a trapped and scam desperate consumer? I am very mad and pissed off at how Hap Mortgage is taking advantage of me. Do not do business with Hap Mortgage. Hap Mortgage will take your money and do nothing. The only way you can get them to do anything is when you call them or go in the office.
