Lawyer from Gordin Complaint - Unethical Practice

Review by YaSasha on 2010-11-15
PHILADELPHIA, PENNSYLVANIA -- Gordin & Berger, Attorney at Law - these guys are scum artists and absolutely non-honest people, making money on other people problems!

Berger was dealing with me trying to get a payment for private school, where my kids were going before I lost a job. I negotiated with Mr. Berger that I will pay small amount of money every month until I find the job and he will not do any actions for now. He sent me a documents which (I thought) explains our negotiation. Unfortunately my English is not good enough to understand all this cumbersome lawyers' specific language and I signed the documents without actually understanding it. I trusted this lawyer and was sure that this problem is solved.
Few days later I discovered that there was a judgment in a court against me and that the papers that I signed declare the statements against myself! And in judgment stays that my debt now are everything that I owned to the school plus 40 (FORTY!) % Mr. Berger fee!!!

This judgment immediately show up on my credit report and, of course, screw up my credit history, myself and my family completely. Of course I call Mr. Berger and ask him for deal reversal, explaining that I made the mistake by not reading that docs carefully because I trusted him, and that I was sure that everything will be the way we both agreed over the phone. But his answer was that it is my mistake, and what happened is happened, and he is not going to do anything to help me or to reverse now, and finally he hang up on me and did not want to talk to me anymore!
Now everything turns much worth - few days ago I found that my bank account (where my wife's salary was just deposited) is frozen! He did it! He left me without any penny now!
This guy is a SCAMMER! He did it to me only because he found that I do not speak English well and, therefore, he could do it!
Now, when I'm applying for any job, the employee are checking my credit history and refuse to take me! And situation become worth every day! All this happened to me thanks to Mr. Berger and his company and I blame him for all my unfortunate now! Even more - because of all the above, I cannot make any payments now. Shame on untruthful lawyers Edward L. Berger! He uses people situations to do his dirty business!
I just found on Internet that there was a class action suit against him. How come this guy still operates? I am going to contact the Bar Association now to find out what is need to be done to make him disbarred. I am reporting him to the better business council too.
Edward L. Berger is the scammer who use unethical practices to collect money! Someone must put a stop to this man! How can he be allowed to practice law?

You made a big mistake by not reading the documents you signed. About the only way to fight a lawyer is with another lawyer. Good luck. You're going to need it.

Not that it makes a difference, but I am almost certain I read this review before. Perhaps it was posted by your wife?

Anyway, if you believe you were misled or deceived, go ahead and report it to the Bar Association. There might be other complaints against this firm.

If I understand this right, the private school your kids went to sent this lawyer to collect your unpaid tuition and you signed the settlement papers without reading them. I would be angry with the school for sending a collections agency to collect the money and not working out a payment plan. What is the name of the school? I also don't think the whole story is being told here.

The documents that you signed will be legal records. Unless you have a recording of your conversations with him, it will be your word against his.

The way I'm reading this, this lawyer was hired by the school, so unfortunately, the last thing you should have done was trust him. I'm sorry this happened to you, but as Alain said, you need another lawyer to take care of all of this.

I am in agreement with those who infer that the lawyer was working for the school, in arranging collection terms for previously agreed to tuition.

I think you are totally out of luck. You signed the papers. It sounds like Mr. Berger is making out quite nicely on this deal, but lawyers usually do.

If you can't understand English well enough to understand the documents you were asked to sign (who could?), then it would have been your responsibility to find someone who could read and understand them and could explain them to you. Unfortunately, ignorance is not a viable defense.
