North American Bancard Complaint - Lied to by the sales rep representing and selling this product
FRESNO, CALIFORNIA -- When I signedup with northAmerican bancard I was told by my sales representative that there would be NO fees of any kind (a witness was present when the representative told me this at the time). come to find out when I get my first statement I am being charged "surcharges" by northAmerican bancard because according to what the representative told me after I called him upset about these extra fee charges he said "oh well the company has to charge you these fees because they have to pay the card companies these fees so they have to charge you for it to pay for it." so in otherwords I told him what you people tell us merchants we can't do charge customers these "surcharges for processing there credit card payments" you charge us and we get hit with more fees. the representative said yes. I was so pissed off at this point and asked him why he lied to me when he signed me up he should of been upfront about these fees and I would not have signed up in the first place. the representative said that it was on the copies of the contract. I says on what page are you talking about I only got five pages of the contract that you gave me after I kept bugging you for copies you never gave me until a month later of signing up. I pulled out the contract and asked him what page cause I only have the five pages of copies that he gave me. the representative did not know what to answer me. I asked him again. he said that the rest of the contract should have come inside the box where the terminal was in. I said what other pages. he said there was ten pages I says what ten you only signed me up with five pages that you had us sign or initial. you the representative never disclosed any of the other pages to us. the representative was mumbling and studdered that the company does charge us a standard "surcharge fees" on all transactions. so in other words I have to pay northAmerican bancard double fees (visibly on the statements). now recently last month in October they charged me a $79 pci fee. I called the representative and he was suppose to meet with me the next day which he never did. he was a no show. I called and left messages. he returned no calls. I called the corp office of northAmerican bancard and was told that the fee is disclosed on the contract. I explained to the supervisor at the corp office that I only had five pages of the signed contract and that was all that was given to me by my sales rep; and I did not know about any of the other pages nor where they ever given to me or in my possession. I requested to the supervisor and the representative I spoke to at the time that I wanted a refund of my $79 pci fee because I was lied to by the sales representative that signed us up and is representing there company. I was told by the lying representative that there was no fees of any kind...a week later I received in the mail a full copy of the ten page contract from northAmerican bancard company. wow! six months later the other missing five pages of the contract suddenly appear in my mailbox?? I am going to contact an attorney I want to start a class action lawsuit. for now I will go around town and discretly asking other store owners if they have a similar situation with northAmerican bancard services and the sales representative representing this company... so that I can start a petition and list for my attorney. if there is an attorney out there already starting a class action lawsuit against this company please contact me I want in on this class action lawsuit.. we need to stop the abuse and scams these big companies are doing on small business owners like myself.
