Unique Pools Complaint - Gross Negligence - Swimming Pool Repair

CEDAR PARK, TEXAS -- My daughter hired this jerk to do some simple repairs on my swimming pool that was going to cost a few hundred dollars. Long story short he scammed her into paying over $4000.00 in repairs with no invoice and the pool split wide open after he was paid and we filled it back with water. He refused to come back and I have been waiting for small claims court to hear the case for over a year.

These guys are not licensed by the state and are free to run however they want. As of now it will cost another $5000.00 to repair.

I think I would forget small claims and get a real lawyer and file a real case. Unless they go out of business, they won't be able to run from the suit and you should be able to include extra losses for attorney's fees.

This was a very disappointing effort of helping this man’s daughter who was a good friend of the family. She had an improperly installed fiberglass pool and spa that was leaking 10 inches of water a day. We fixed that problem and she asked for new tile and new paint of the pool and spa. Of course when you paint a pool you have to drain it.

I informed her that when draining a fiberglass pool, it is susceptible for possibility of coming out of the ground if it rained, and rain was forecasted. Therefore, we brought in thirty 55 gallon plastic drums, filled them with water and placed them in the pool hopeful to prevent any issues in case of rain.

We retiled, painted, finished the job and she refilled the pool. This job was done at cost….I did not charge her for any of my time spent since she was a friend. Perhaps her father doesn’t know that the paint and primer alone for a fiberglass pool is $2500. The rest was spent on tile and labor. I made no profit whatsoever.

When I left the job her pool was fine. A few weeks later she found a crack in the shallow end. It was not there at completion and was not my responsibility as this was not in the scope of work and not a result of painting her pool.

These people filed a lawsuit against me to obviously try and recoup whatever costs they had fixing their issues after I was finished. The truth prevailed as the court ruled in my favor because the evidence proved what and who was right and wrong.
