T and D Waterproofing of Pittsburgh Complaint - Refusal of Paid Services

My name is Greg McGeary, and I live in Jeannette, PA (Penn Township) with my wife and 3 children.

In 2005, I had a 25' X 25' addition placed on my house. The Contractor was Pat Adamson of Claridge, PA. When the foundation of the addition was laid, I paid approx. an extra $5000.00 for waterproofing of the addition. I was assured that the addition would remain dry. I spent several months and money to finish the addition myself. I added all the wallboard, trim, wall to wall carpeting, furniture, etc. On March 16th, 2011 during a rain storm the addition began to flood badly. All of my carpeting, furniture, etc is ruined and the entire room will have to be repaired and replaced. Now there is mold and mildew setting in real bad. In the home, it's myself, my wife, and I have three children. The mold is beginning to become a health hazard, as we are all experiencing sore throats.

Pat Adamson contracted T & D waterproofing of Pittsburgh to do the work. They applied a waterproofing product called Tuff -n- Dry made by a company called Tremco. Tremco and T & D waterproofing guarantee the product and that the foundation will not leak with a 30 year warranty. I have the warranty contract. I have made several attempts of the past 7 days to contact Tremco, and have left several messages, as well as several emails. I have gotten no response from anyone at Tremco. I also contacted T & D waterproofing of Pittsburgh, and I explained to them what was going on. They said that it was impossible that this happened and they are blaming it on the other contractor Pat Adamson. Also, T & D waterproofing is refusing to come out to my property and look to see what happened. Again, I have a 30 year guarantee on the foundation waterproofing. I am being ignored, and the contractor is refusing to service the Guarantee. Shortly the mold and mildew will be so bad that I and my family will have no choice but to abandon the home. My request for help from all parties involved is being ignored. I am not sure what to do. I hope that somebody can help us.

Have you filed a claim with your insurance company? This may be covered, depending on your policy; if so, they will seek restitution from the contractor, manufacturer, etc. If it is excluded from your insurance, then it seems you will need to begin legal action, which will probably require an attorney. If your basement flooded then it wasn't a waterproofing failure. You have a flooding/drainage issue. Contact your homeowners insurance agent and let them sort it out.
