WAPPINGER FALLS, NEW YORK -- We had placed an offer on a house that the seller accepted. We had the inspection done which cost $ 620.00. We received the contract from the seller's attorney on a Friday. By Monday, we received a call from our agent stating that the seller's agent, from Century 21, called her and said that the seller accepted a higher offer. Therefore, they were taking back our accepted offer. Ethically, the seller's agent should not have taken any more offers. Especially, since we already received the contract and spent money on the deal. This action was unprofessional. Nothing was offered to rectify the situation. We were played dirty. In this economy, everyone works hard for their money to have someone just take it away.

something don't sound right here. laws in different states may differ, but normally you don't do a inspection until you have an executed contract. in most states an executed contract is one where you signed it, and the sellers signed it and it was delivered to escrow/title. once its there you have normally between 7 and 10 days, depending on the contract and state, to do the inspection. did the seller sign it? did you see the signed contract? did you sign it? and return it to the seller?

Both party's have to have signed contracts before its binding. if you got the contract from the seller, and you signed it, but did not return it to the seller or his agents, then you don't have a contract. in that case the seller is free to accept other offers and reject yours. in some states in fact, if the seller signs it, sends it to you, you sign it, the seller can withdraw his right to sell it to you before the contract is delivered to him, even if its signed. what you need to do is check your local laws on real estate. most states have a web site for the real estate dept, I'd look your up. then once there you can find the state laws on contracts for real estate.

never do inspections till escrow is open.
