I didn't use their service They wouldn't refund my $3000 - Complaint
Review by Crocus on 2011-04-08
SPRINGFIELD, MISSOURI -- I went into their office June 21st 2010 to see what their business was all about. I only talked to one person who used pressure tactics to convince me that I could get flooring carpeting and furniture much cheaper with them than anywhere. I believed them but kept asking questions because I just wasn't sure about it. I wanted to wait but he said I needed to sign that very night. I wrote a check that night for $2,990 on the way back to my home in Nixa I was feeling sick because I had a feeling I'd been taken. I found out later from people that their materials was inferior and I found out I could get excellent quality furniture, flooring, faux wood blinds and windows cheaper than what they had to offer. I went in later by the time I found out the truth they said I wouldn't be getting refund becaus too much time had lapsed. I called them several times and they still refused. I'm an 80 year old retired teacher who taught in Worth County for several years and am living on my pension. I have no money left in the bank. I just paid my Federal taxes today $845 and it wiped out my bank account. I won't get my pension check until the last day of the month April 2011.I need that $3,000 desperately.

My daughter is on disability and can't afford to pay for all of her medication and Doctors bills. Her husband is suffering from congestive heart failure and I've been helping him with his meds and doctors bills He was in the hospital for a week about a month and he's unable to do any work. Is there any way I can get the money.

I can't afford to pay a lawyer. I'm at the mercy of this swindling company. The name of the guy whose part owner of this Company is [snip].

I have a feeling that a lawyer wouldn't be able to help anyway because there's probably a time limit on when you can cancel out.

I sounds like you made some decisions before doing your research. I appreciate that this puts you in a difficult position and wish I could suggest a real solution.

It's usually within 72 hours you have to cancel a contract, and get out of it.

What does the contract say, regarding their cancellation policy?

Always trust your gut instinct. If someone has to have the money right now, and wont let you think on it, chances are they just don't care about you and just want your money. Am sorry you have to go through this, i know how its like to be on disability and not be able to have a lot of funds myself. This company is more for people remodeling a whole house or enough buildings to actually save. And unfortunately, i dont think theres a lot that can be done with this company. But good luck, i hope you find a way to get out of the contract without any more fees.

Unfortunately you are bound by the wording in the contract. Even if there is a cancellation window I am sure it would not extend from June 2010 till now. Direct Buy is very unlikely to sympathize with you. They are all about the money. They got it and they ain't gonna give it up! In most states the 72 hour contract recension rule only applies to sales contracts you enter into IN YOUR HOME. As is door-to-door solicitations.

consumers are just wrong to keep repeating the myth that you have a 72 hr recission period. That ONLY applies to contracts signed away from a companies office, such as a fair or home show, or in your house. When you sign a contract at the vendor's place of business there is absolutely no requirement to offer a cancellation policy.

I don't know if it would do any good but you could try contacting your local news about this. It may not get your money back but it would expose this company as to taking advantage of seniors. There are a ton of complaints about this company on the internet. By the time you pay the membership fees and it says on the internet they tack on more fees when you buy something, you can get the same furniture at other places cheaper. Clearly, an 80 year old person would not benefit from a program like this and I think you were scammed along with a lot of other people.

Unhappy has a great idea. I think they took advantage of you being a senior. Shame on them. If the local news does a story for you, at least you will get the satisfaction of knowing they will get some (more) bad publicity. I really wonder how this place stays in business. Good luck!
