CINCINNATI, OHIO -- To whom it may concern,
2 weeks after closing on a home in Green Township (on the west side of Cincinnati), I found a sign below my driveway that was overgrown and was a marker for a pipeline. I called the pipeline company who came out that day and staked it off. I found that this is a 20-inch pipeline with 700psi and pumps thousands of gallons a day of crude oil from Texas to northern Ohio. The sellers never disclosed this to me; the title company gave a report that it was a 20-foot easement with no mention of the pipe. After meeting with the pipeline company we found out that it was a 50 foot easement that went right through the middle of the front yard and my living room, porch, steps and much of the yard, which we were going to develop, was in the easement. The title company furnished a revised report after I made calls to the lender, my agent and the title company. All this of course was after closing.
The next problem is that this house was purchased on an FHA renovation loan. The appraisal company did not report the pipeline and FHA would not insure a home that's property is within 10 feet of the easement of a high-pressure pipeline. (Much less having 5 feet of your living room in the easement!) Had the seller, lender, Title Company, or appraiser informed us of the pipeline prior to closing, we would not have purchased this home.
I am married with 7 children and the joy of buying this home, in a small quite neighborhood, has turned into a long summer of research and frustration over this pipeline. I have found there are others who have been affected by pipelines on the Westside and I do not want anyone else to have to go through what we have in the last 7 months.
We are awaiting word from the lender as to what they are going to do to correct this situation. They are the ones that hired the Title Company and appraiser and if they had done their job correctly, we would not be in this situation. FHA has stated that it is the responsibility of the lender to be sure that the home is ELIGIBLE AND MARKETABLE AND THIS HOUSE IS NEITHER!
There is so much building going on in Green Township, and around the country, that I want to inform others, to be sure and find out before they close on a home, what the easements are and how they affect the property they are buying.
I would like to hear from you soon as I believe this is a story that may save others much expense and grief.
