Americredit Complaint - How to deal with those collection calls:Part One
By law a collection agency can only call and speak to you once a day. However they can call and leave messages as many times as they want. (This is not considered harrasment legally because they are collecting on a debit and they have not spoken to the buyer or co-signer.)
However by law if a collection agency calls your place of employment or your spouses place of employment all you have to do is let them know that you cannot receive personal calls and they have to remove the number.
If you really want to have a collection agency stop all of the collection calls to your cell, business, or even residence, simply send a "Cease and Desist Letter" to them and the calls will stop once they recieve the written notice. Keep the letter on file for reference.
If the calls contiune you may be able to pursue legal action against a collection agency. Ask for a supervisor and let them know you were contacted after a Cease & Desist was sent to thier company.
Make sure you indicate the numbers that you do not want them to call in the letter. Now you may be thinking,"What if they repo my vehicle?" Remember by law a car loan agency cannot repossess your vehicle until they have first given you notice that your account is delinquent. So it will be your responsibility to get that payment in before 30 days of being past due. (This depends on the state you live in so check the local laws first.)
