I purchased a computer from Apple and refinance it via Juniper. I had three month to pay the balance in full with monthly payments. I was one day late on one of those payments and they charged me a late fee of $29.00. They refuse to forgive the late charge. At that time I was financially tight because of the new mortgage. I finished paying on time the balance in my account after the three month, Dec 2007. I refused to pay the late charge. They continue charging me late fees on the late fee until the balance grew to $216.10 back on May 2008.
Now on May 2011 I continue to being charged and harassed by collection agencies who keep buying these bad debt account from Juniper and among each other in the believe hat I am going to change my mind about paying this account. Balance is now $471.97 by RPM (Receivable Performance Management LLC). They are calling every day. I try to settle this unjust bill with Juniper in May 2008 but they refused! Have copy of all the documentations. They off-course reported this to the Credit agencies and I am getting a hit of about 70 points in my credit score. I have 3 mortgages in my name for over $400,000.00 dollars and never once been late on any payments or any other CC debt in my life. Then you have this wolf practices by lenders like Juniper!!

I am willing to pay a lawyer to take this case and fix this glitch in credit but also will like to take Juniper and its credit debtor Co. One cannot charge late payments on a late payment fee for as long as they wanted. Ever since 2010 this is outlaw! Ever since then I have gotten away from CC.


How can they get away from this. Hoping that there is justice for all in this case. Shame on you Juniper Wolfs!@

Late is late. Doesn't matter if it's one day or one month. Sure, they could have waived the late fee as a one-time "courtesy," but they're not required to do so. When you financed your computer with them, you agreed to their terms. One of those terms, I assume, was to pay the bill by the due date or a late fee would be charged. You violated those terms, and now you have to pay the consequences.

So... you had a late fee of $29 in 2007 and you stood your ground and refused to pay.

And now over 3 years later, it's grown to over $400 and has gone to collections, which also means it's on your credit report.



I've read a lot of reviews where people say, "I refuse to pay that bill!" somehow thinking it will make the company cave in and forgive it instantly. Many people don't realize that this action could in fact cost them a lot of money and hurt their credit status.


Although you may disagree with the charge, the time to address it and try to fix it is when you first get hit with it. And yes, sometimes the answer is "no".

And if you chose to ignore it and refuse to pay, that's your choice.... including the consequences that come with making that decision.

The good news is that this debt is probably not enforceable in court. No judge is going to award $471.97 for an original debt of $29. In fact most judges won't enforce late fees at all because they are punitive in nature therefore not valid.

If it were me I wouldn't sue. I'd wait it out. The hit to your credit report will lessen with each passing month and these guys will never sue you. This paper will merely get passed around from one collector to the next for the next 20 or years. Soon you will get settlement offers of ever lessening amounts. Ignore them. Don't ever pay a penny on this.

This does illustrate the inequity in the law in that these sleazebags can harm good citizens for seven years without ever having to show cause beforehand.

Taylorh2, Late fees are punitive by nature and therefore unenforceable in most courts unless it can be proven the fee represents an equitable and compensatory harm OR specifically allowed by state statute. That's not me talking that's the law. Now any company who tries to extort $471.97 for an invalid claim is a sleazebag in my book. There's a reason these scumbags never let these claims see a court room. Sorry man I just call'em like I see'em.

By financing through Juniper, you promised to pay and pay on time. You were late--even if it was one day. They have/had every right to tack on a late fee. You and only you have let this balloon to over $400.00. Just because you ask does not obligate them to forgive the fee.

I don't understand why you would choose to pay a bill charging single digit interest instead of a bill charging over twenty percent. You agreed to the late penalties when you used the card. You chose to not fulfill your obligation and must pay the penalty. Good luck spending thousands of dollars to avoid a few hundred dollar bill.
