Refund of Our Escrow Money

PALENTINE, ILLINOIS -- 6/6/2017. We paid off our Mortgage, and were told we would receive our Escrow money in 20 days. We're still fighting for it 2 1/2 months later - ready to take it to a lawyer now. They say they issued us a check and we never received it. We spoke to them and were told they would direct deposit the money into our bank account, this never happened either. Then called back to inquire about that, and was told a new check was cut now and put in the mail again - they never even tried to direct deposit after taking all our banking info and telling us they would. This is our money...not theirs.

Now our house taxes are late, we got charged a late fee, and had to take the money out of our savings to pay them. Still no check from Ditech!! And the person head of escrow dept is not even returning our calls. We were also with Green Tree and sold to Ditech - so it's not like we had a choice. Funny thing is all my house payments and my final pay off payment on my house - Ditech has always received in the mail...no lost mail there. Only lost mail, when they send you a refund?

CALIFORNIA -- Absolutely horrible company!!! Never dealt with so many incompetents!!! After having Citimortgage for almost the entire time I have had homes (2 condos and 1 home). After hitting hard times back in '09 we had a modification done through Citibank and no problem. We made our payments then after the modification was done Citibank sold our mortgage to Greentree then all of a sudden Greentree was "sold" to Ditech, a Walters Company which basically changing names.

I tried another modification through Ditech and got all the documentation which I faxed over twice (80 pages) saying they never received the docs and I have the receipt to prove they did. I then mailed the docs, again got the same response, never received the docs.

They were supposed to waive two late fees but never did and when I called today about why they haven't applied my payment for May, they said they never received it, so now I have another late fee added on and when I asked about the two late fees being waived this customer service representative says I don't see anything in the notes and she can't do anything about the late fees. Unbelievable, I can believe this company can get away with so much, just Google the 581 complaints about this company.

RAPID CITY, SOUTH DAKOTA -- When we bought our home it was through Green Tree, which were ok to deal with. However, our loan was sold to Ditech, or the companies merged, whatever. Ditech now has our loan. I became physically handicapped and was unemployed for nearly 9 months. I struggled to make our payments. Tho admittedly payments were at times late. What I did not learn until recently, Ditech does not accept partial payments. So all my payments were not being applied to my account. Yesterday I received a check for several thousand dollars. Curious I went online, and saw my account is $9,000 in arrears. WTF?!!

I've been making payments. Now Ditech tells me I have to pay the whole amount to keep account current. How? When they are still holding most of the money paid? And tell me I will get that money back in a few months. In a few months any mortgage payment I make will just be sent back to me... in a few months. This is a complete scam to purposefully repose on peoples home, and prey on them. To take advantage. How come this company is not being investigated for fraud, and God's know what else, is beyond logic and reason.

Ditech Is a Shady Company

WADDELL, ARIZONA -- Ditech bought out my original mortgage. As soon as they took over, they started charging me more money for PMI, then wanted to charge late fees for being short on my monthly payments because they decided to charge more money without notifying me. I then requested to drop the PMI. After several phone requests over several weeks, they eventually said I have to send a written request to drop it. I sent that in, then made at least 10 calls to them over 6 months to follow up to no avail. Finally, I resorted to threatening them w/ legal and exposing them to public scrutiny.

After a couple more weeks, I got a call stating that if I didn't answer calls from the appraiser, my request to drop PMI would be dismissed. I told the girl that apparently they have the correct phone number since she got a hold of me in one phone call! She admitted they (apparently) were giving the appraiser the wrong phone number. After all this time, they eventually got my PMI dropped, but they did everything they could to drag their feet and do everything possible to keep me from dropping the worthless PMI. I have heard many similar stories in the last year of people fed up with this shady business!

Overcollecting Escrow, Not Paying Taxes

OHIO -- DiTech obtained my mortgage from Green Tree. They have messed up from day one. In 2015 they missed a tax payment. They sent my insurance company a check for $3007.77, when the bill was only $1347.00. After numerous calls they paid the overdue taxes from 2015 in 2016. Fall of 2016 they failed to pay my taxes again, until I made several phone calls. I was late with two payments, due to being off work for surgery. I paid the late fee the following month. They still kept charging the late fee.

I called and was advised to pay the fee again, so in Dec. 2016 I paid the fees a second time. They are still marked unpaid. I call, no help. I write letters, I just get a letter saying they are looking into it. But things never get resolved! Now they have raised my house payment over $200 a month, but no one can say why. I have a fixed mortgage. They are collecting almost $3600 a year more for escrow than needed. They told me they will review it again in Sept. 2017. They are ripping me off.

Inept Would Be a Kind Way to Describe Them

PASADENA, CALIFORNIA -- Ditech misapplied my escrow payments to my mortgage which put me into arrears on the escrow account. I sent the payments through their escrow address in Pasadena but they listed them as UN-applied funds. Then they misapplied my monthly mortgage payments to escrow claiming I had missed my monthly mortgage payments (this was done monthly through autopay).

I have talked to numerous reps who have promised to call me back when they reconcile my transaction report. Zero calls back. Called the extensions I have been given, no answer, and no voice mail. Plus every time I call in they indicate I owe a different amount with a swing of $2000.00 difference. They will not give me number for the Escrow Group so I can bypass reps that don't even have my transaction report to refer to. Simply, they don't have a clue.

PENNSYLVANIA, MICHIGAN -- Quoted $24,000 for two months. Just before closing, they said they would have to have $35,000. Most dishonest and fraudulent company I have ever dealt with? Hope they go bankrupt and all upper management gets indicted for fraud.

Stay Away From DiTech Mortgage

Dear DiTech, it has now been more than 45 days, and you have still been unable to close on my property. As I sit around awaiting your next request for “additional documentation”, I am forced to endure your latest commercial in which you tell us that “we are smart”. Thank you for taking the time to praise the intellect of millions of American consumers. Being in the banking industry certainly qualifies you to make broad-based intellectual assessments about people you have never met.

Contrary to the belief of your advertising and marketing department, smart people do not need a commercial to tell them that they are smart. Targeting the intelligence of the consumer is a time-dishonored method typically used when the product being sold is particularly difficult to sell to people who actually do possess a modicum of intelligence. If anything, your latest commercials now have me questioning my own intelligence for even considering a mortgage through DiTech. I would say to all the “smart” people reading this post to AVOID DiTech at all costs.

I have found their team of mortgage brokers and underwriters to be some of the most incompetent group of individuals I have ever dealt with. This especially applies to the broker that was assigned to me. I have never dealt with such an uninformed and rude individual in my life. I won't get into specifics, but let's just say that he hung up on my closing attorney's office when they rightfully inquired and demanded an explanation about ongoing delays in processing the loan.

I didn't realize the true extend of DiTech's incompetence until I became frustrated and contacted another bank who claimed they could close on the property within a week. I'm happy to say that they were true to their word and that I will be closing on my new property on July 17, 2009. My new bank will not be “losing another loan to DiTech”. In fact, it is my hope that anyone reading this posting STAY CLEAR of DiTech – unless of course you have a few months to kill before your closing and don't mind being inundated with endless requests for “additional documentation” from ignorant and uninformed individuals who take days to respond to simple inquiries.

Bad Customer Service

I found myself in a situation, partially my fault, but I realized what kind of company they are. I overlooked a notice that my payment was going up (due to lack of escrow funds). I received a notice that I was late. I had been making my payments as they were before the change, just not the additional they added.

When I called to make arrangements, I told them that I could begin making the updated payments for the next month and catch up on the past due amount. They told me I could not do that, as they applied all money sent to the past due amount and $100 in late fees first, no matter how I would have liked the payments to be applied. When I tried to make a compromise to prevent a negative credit report, they told me they had already negatively reported me to the credit bureaus, as well as the late fees. They were very inflexible.

I sent a letter explaining my dissatisfaction about the way my case was handled and that I would be seeking refinancing as soon as my credit rating would allow, and was sent a letter back saying they were "unable" to change the negative credit report, and that I could write a notation to the credit bureaus explaining the situation.

They obviously didn't pay attention to my first letter, as I did not ask them to review my case, just voicing my unhappiness and intentions. They, like other big companies don't care and don't see us other than numbers in their systems. As I was told by a department store manager at one time, "one customer doesn't make a difference". A few years later, that store, Montgomery Wards, went bankrupt and closed. One may not, but many eventually will.

Charges Above What We Were Quoted for Closing Costs

COLORADO SPRINGS, COLORADO -- I phoned DiTech on 20 March 2008 and wanted to refinance our home loan and roll in our line of credit. I spoke with Teresa ** and she was very considerate. I asked her what my payment would be and also what the total closing costs would come to. She quoted me $9,000 for closing costs. She told me that the refinancing with the closing costs would come to 282,000 and that she would make the loan for 285,000 and I would get back 3,000 at the closing table. I agreed that was fine.

Well, I received the paperwork the next afternoon and it showed nearly 12,000 in closing costs. DiTech had their fee added in and I was never told. I wouldn't be getting anything back at the closing table. We called Teresa immediately to question this and asked why we were never told. She apologized and said she would have to take this to her supervisor. She then told us that she would not be on on Friday, but would call us on Saturday with a resolution. She didn't call, we had to hunt her down.

Then she told us that she didn't have an answer and that she would get back to us on Monday, the 24th of March. She didn't. I kept sending e-mails and leaving voice mails to get this resolved because DiTech had their appraiser coming out on Tuesday morning. The loan has now shifted to ** who also assured me that I would receive a phone call today from her supervisor, Jackie about the problem. I never got the phone call.

I received a phone call from DiTech last Friday from some guy that wanted to apologize to me for my misunderstanding. I don't think so, I explained that we were never told about DiTech's $2181.00 fee. He said he would have to escalate it to his supervisor, and he would be in touch. Guess what, they never called back. Way to lose a customer.

Hey if they don't want to make the $300,000 in interest over the life of the loan, their loss. I am so disgusted with all of this. I have e-mail after e-mail and read receipts from DiTech. I know they got my messages, they just chose not to answer. Be very cautious if you plan on doing business with DiTech/GMAC. They are very underhanded.
