Warranty Misrepresentation

DALLAS, TEXAS -- Morgan Buildings & Spas uses their 'warranty' as a big selling point. But, as we have found out, their 'warranty' is in fact a joke. We bought a shed in 2000 and recently discovered that one of the supporting wooden beams is rotting. More than 2 months after we first contacted them about it they sent someone out to inspect the shed, then they claimed that the shed was getting wet because of our sprinkler system (duh - it's outside in the back yard) and so was not covered under their warranty. Since they didn't tell us that their sheds are apparently for indoor use only, I contacted the Regional Sales Manager, then the National Sales Manager. To date, we have nothing from them - they never return calls, nothing. I have also filed a complaint with the BBB as Morgan is apparently not a bit concerned with customer service. THis is a lousy comapny & I would encourage anyone who may be considering buying anything from them to definitely shop elsewhere.

You are so right about Morgan Building and spa. They are joke. Anyone that buys a shed or anything from them you will do better going to home depot. Because Morgan do not honor their warranty and they certainly never return your phone calls.They are so unprofessional they cant even give a payoff balance all you get is answer machine and never get a return phone call. What a bunch of LOSERS>

Ordered a storage building in March 2013. It is July and we still don't have the building. Phone calls are never answered and if you leave a message they never return your call. I agree, I wish we had seen these reviews before doing business with Morgan buildings!

Paid for a building in November 2012, they scheduled delivery date first week of February, today is the 25th of July and still no building and they refuse to give me my money, claiming no refund is the company policy, will give a credit towards other merchandise, but where would I get this other merchandise. Delivery date is only an estimate????? Baton Rouge office closed and so did the New Orleans office. Both have been the subject of television news reports of ripping off customers.

Bait and Switch

ALBUQUERQUE, NEW MEXICO -- I purchased a used Morgan Spa from the Albuquerque, NM store. I put 500.00 down. The total purchase price was 2000.00. I was told a credit check would be run and I would be offered financing. After three days, I received a call. I was then told I was denied credit, but they would finance from a company called "US Credit" at 18%. I declined this and asked for a refund of my deposit. They claim it was earnest money (which is a legal term for a deposit in good faith) I never had the spa in my possession. They had the spa still at their store. It was less than a week from when I put down the deposit. They refused to return my deposit.

I have no problem with being denied credit, though I know my credit score is in the high 700's. I do however know that laws in all states allow for return of product in original condition with in a certain time, usually 15 days minimum.

Morgan Spas is a company that will do this bait and switch on financing.

Check your state laws. I think the right of recission is three days but I think it varies by state.

I don't see bait and switch here - where is the bait? You applied for credit and were denied - out of control of the store. Did you ask them about what would happen in that event when you committed to the purchase?

The contract was conditioned upon the OP getting financing from the original lender. When that did not or could not occur, it was impossible to perform the contract. Both the store and the OP agreed that was the basis upon which it was sold, otherwise the OP would have been given the spa immediately.

He is entitled to a refund of his deposit, since it was impossible for the contract to be completed because of the rejection by the original lender. Write a letter, certified, return receipt, demanding the money back. If they do not respond appropriately, sue them.
