COMPLAINT against NCO Financial

I had two collection accounts that were bought by NCO. One I had paid in full in Jan 2007, and the last I just paid in full on Aug 06, 2007. I was informed that I would be charged nothing else and my other electronic payments would be cancelled. I check my account this morning and to my surprise I have an electronic check for $50.00 that was pulled on Aug 24, 2007. I have been on the phone with this company all morning, I was told to fax my copy of this check to a 877 fax number, but of course it will not go through. This is my fourth time faxing this info so that I may get my money back.

When I called again and asked to speak to a manager or supervisor I was told that the managers do NOT take phone calls. What type of company is this? I found information that this company has violated the Fair Credit Reporting Act and is charged with a 1.5 million dollar civil lawsuit. This company needs to be shut down and pay back everything it has wrongfully taken from consumers.

Horsham. Say the name of the town ten times real fast and voila, you get another name. I am writing as much contact data for all those who are tired of phone calls with these clowns. You simply write a letter telling them to cease and not call you.

Then you send a certified letter to the address in care of the president. If enough people force them to only write letters and they do not, then everyone can get together and file a class action lawsuit against the firm and their clients. PLYMOUTH, INDIANA -- I actually have mixed reviews about this company. I have had numerous medical bills go to NCO. I have been a victim of the countless calls, etc. However, I can't say that I blame them for wanting to collect their money! We just weren't in a position at that time to pay them. At one point I set up a payment plan with them and had to have a payment be late because of a vehicle breakdown. I just called the regular representative and he agreed to note that the payment would be mailed the following week.

My main complaint is that if they take you to court, they do it right before Christmas!! Not that we had a lot of money for nice Christmas presents or anything, but that 50.00/month demand toward the account was pretty salty and pretty much left us with nothing for our kids.

I actually came across this site when looking for their number as I was in a car accident in October and the other person's insurance has not paid my medical bills (as per the settlement agreement - I think I'm going to see if they're listed on here next and post a nice litle review about them) and those medical bills were turned over to collections. I was hoping to contact them before they contacted me and pay it off and hopefully they would agree to remove it from the credit report based on the circumstances.

But anyway, my experiences with NCO have simply been embarrassing, more than anything, but I think that I may be more cooperative than some because I understand the importance of paying debts, but there were just times in my life where it was not possible. Instead of getting angry that they were calling me because I "gasp" owed them money, I really tried to put myself in their shoes.

Anyway, again, I have mixed reviews. They do call too much and sue at the wrong time of the year, but I've found that when I'm cooperative with them, then they are cooperative with me, at least on the debt collecting end of it. I don't know how it would be to have to dispute a debt with them though, because, well, I've never had the opportunity.

A note for those of you who work for NCO - You are not only pursuing a reprehensible career, but you are in fact, bad people. Like many, I've been in collections for various debt through time, and NCO employees must be the most dense and unkind people I've ever had to deal with. You attempt to vindicate yourselves by saying you are "just doing your job". By that rationale, anyone can vindicate themselves for doing anything, as long as they're being paid to do it, including hitmen and Nazi soldiers. If you don't want to catch heat for what you do, perhaps you should pursue a career in Greenpeace.

If I (or anyone) doesn't have the money, that's it! Its not there. Empty threats and angry words will not make the money mysteriously materialize. It's amazing how little power you actually have in the end. There is NOTHING you can do that a company cannot do for themselves. The difference is, you pursue and maintain resources that make it even easier for a huge company to trample a small company or consumer, usually using fear tactics. Keeping that in mind, fear tactics do not work on me. I'm doing better now, but when I had collection calls coming in, that bill or whatever the case may be went directly to the bottom of the pile.

I wholeheartedly encourage readers of this board to do the same. If they get nasty, ask for an address where you can send a cease letter. Send it. Know your rights and employ them. If you ever feel that a collector has broken the law, immediately report them to the FTC and pursue prosecution and civil litigation to the full extent the law allows. Make sure to go after the actual collector as well as the agency. www.ftc.gov/os/statutes/fdcpa/fdcpact.htm Learn it and know it!

The system is set to trample people who are struggling instead of help them. Put a few of these chumps on the chopping block, because until someone does it will never change! Whew, I feel better. All that being said I wish untimely painful death on every last one of you.

HORSHAM, PENNSYLVANIA -- Never underestimate the power of the people. As of this posting, my letter to the Mass. Attorney General (posted here on my3cents) is #9 in the top 10 results for a Google search on "Chase Providian" - Maybe I should switch to a career in copywriting.

Also found a couple references to Chase and Providian, regarding class action suits against them. Very interesting but not very encouraging if you hope to see any large sum of money from such a suit. The info on Chase and Providian:

Chase -- If you have a card issued by Chase, perhaps you noticed a ten cent rebate on on of your monthly statements several years ago. That generous refund was the result of a class action lawsuit filed against Chase for dubious billing practices (not posting your payment on the date received as required by federal law).

You only got ten cents because the lawyers who filed the class action suit took a big chunk of the $22 million settlement as their fee. There was so little left that everyone got just ten cents. (Most class action lawsuits against credit card companies result in a windfall for the attorneys with very little left over for consumers.)

Providian -- The king of unscrupulous billing practices and immoral behavior, Providian is considered to be the baddest of the bad credit card companies. It got caught overbilling its customers and had to pay the largest judgment ever awarded against a credit card company, $300 million. They improperly assessed late fees and charged customers for products never ordered (e.g., credit insurance).

Many visitors to this website reported that they received checks from the California Attorney General for as much as $200.00 as a refund for Providian's billing overcharges. Providian was also signing up its customers for credit insurance without their permission. What a wonderful world we live in.

Settle or Fight?

SAN JUAN -- This person called me at home, on 12/18/03 demanding payment that was due since March 2003. The first thing that I explained to him was that I thought that the payment was taken care of a long time ago and that they had settlers sending letters because the bank that owned the cards had some serious trouble with the FDIC and all their accounts were closed. He briefly explained something about it, but then demanded that I settled the amount. Then I explained to him that I am currently unemployed and that someone takes care of all my bills.

He insisted on charging this debt to another Credit Card. He was asking me about other accounts, stating that he was "pulling the info from my credit report," and I know he was because he was calling them by name. He said that "I have good credit but if I do not settle that account HE would damage it."

He asked me if I could send an OVERNIGHT payment. I said I'd try but that it was too much money. He wanted me to call him again before noon the next day with the tracking number information. The next day, he called around 2 PM, and I was not home. He left a message and then called on Saturday morning, 7 AM my time, asking me why I didn't call him. I told him that I was not home and that I did not have the money. He wanted to settle for 2 payments with a checking draft. I explained that my daughter would pay if he was able to give us another month. He declined.

We had no other choice but to give him the account information with the checks because he was very rude and sounded very threatening. He sent us a letter to inform us that they would deposit that on X date and that we should make sure that there were enough funds to cover the check. I don't know if what happened later was God's way of helping us, or to make me check them out, because the checkbook was stolen and my daughter had to close the account. After reading all these reviews and realizing that I'm not alone, would it be a good thing to call them and advise them about the checking account incident? What if they start yelling and harassing me again?

Federal Fair Debt Collection Practices Act Violations

HORSHAM, PENNSYLVANIA -- This company has harassed me for several months with their debt collections and I'm not even the person they are trying to reach. After repeatedly, as in the dozens of times, telling them I am not the person they are trying to reach and that I have no information on the person they are trying to reach and that the number they are calling is my number and not connected to the person they are trying to reach, they still call multiple times daily. Now, they won't even identify themselves when they call but they can not hide their phones numbers from my phone company. I have phone company documentation that they called four times since early this morning.

Every reference I can find on NCO Financial Services indicates that they have a consistent record of violating both federal and state laws involving debt collection. That shows their lack of ethics and, naturally, honesty. I can reach no other conclusion considering they continually harass me and I am not the person from whom they are trying to collect and have told them so many, many times. This company needs to be shut down and its principals jailed.

Computer Collection Message

Within minutes of getting a number installed I started getting computer message calls telling me to call this John ** and the number comes up as belonging to NCO Financial when I Google it. I know they are not looking for me as the calls started within minutes of the phone being installed so there is no way anyone looking for me can get access to a new number that fast.

My complaint is partly because it is a computer calling and there is no way to tell the computer you are not the person. And they do not say who they are looking for and I am not going to call a collection agency and give all my personal information just to try to fail to tell them not to harass me looking for someone else as collection agencies never listen when you tell them you are not the person they want. Also if it would have been a live person calling I have to use a TTY machine so there is no way I can respond to a person calling without going through the relay service first.

Harassing Phone Calls

PHILADELPHIA, PA, PENNSYLVANIA -- I receive an automated message every single day including Sunday morning!! There is absolutely no way to reach anyone there - I am recently divorced and they are not likely to be looking for me... I recently refinanced and have a near perfect credit rating and no outstanding debts. These people are so disdainful. I would not even help them find my creepy ex-husband. They are on their own with that.

I sent a letter to their headquarters warning them that I will join the class action lawsuit against them if I get one more phone call. All they do is buy old bad debt that someone else couldn't collect and see if they can get a few pennies on the dollar when really it's is non-collectible... They just harass people into paying some portion of the bill and it all goes to them! What a racket!
