Predatory Credit Practices by B of A

I called Bank of America wanting to see if I could get my credit card rate reduced. They slipped a rate increase in on me over a year ago, and I didn't see their little notice until it was too late to opt out. I have had my "Premium" Bank of America card since 2002. After they raised my rate, I protested, but they refused to lower it.

Since then I have just paid the bill every month in a timely manner, paying over $2400 interest in the last year alone on a $10K balance. When I called to ask them to reduce my rate, I pointed this out, and they referred me to their department for that, and I got someone who identified himself as **.

** said B of A does not lower their rates unless you go through their preferred "3rd Party Credit Counseling" company and do a debt reorganization process. He got heavy-handed with me in the process, saying if I didn't do the credit counseling, my credit would eventually be ruined. Now understand, I have a general history of maintaining my credit on time, and I was being very polite with him.

He was just making all kinds of assumptions about what a deadbeat I was and telling me how hopeless it was. He wanted to transfer me directly over to his credit counseling company while he was on the line, and he wouldn't tell me this company's name either, he generalized it to "oh there are several..." Only after I questioned him on the effects to our credit rating did he admit that this credit counseling would damage my credit rating for the next 5 years. He was trying to tell me it really didn't matter, that I didn't need a good credit rating because I'd probably just go do damaging things with it!

I took the company's number (800-214-7996) and politely begged off. I wasn't ready to just stop trying with my credit, and I'm not ready to trash my credit, and that is my right. Even then, he continued to make these insulting remarks about how things were just going to get worse for us. But the part that really got me was, 2 minutes later, he called me back to inform me that he had just slashed the credit limit on a credit card in my HUSBAND'S name, which we had recently paid DOWN by $2000.

He had reduced it down to very close to the new balance we had paid it down to, apparently in response to my asking for an interest rate reduction. I asked him, "Why did you do this to us? I went to a lot of trouble to pay my husband's card down, to improve our credit score; the balance-to-limit ratio matters in our credit score, we've been told this repeatedly."

First he said, "Well, it isn't your card anyway, it's your husband's card." And I answered "I pay the bills and I know what we paid on it and why it still hurts our credit? We have been working so hard to improve it." And in reply he threatened, "Well you shouldn't complain. I COULD just close your cards on you."

I was flabbergasted. He further went on to tell me that the balance-to-limit ratio doesn't matter much anyway, not to people like us. I was just so angry at his tactics because I believe that the purpose of this was to try to force us into a position where we would have fewer options. You know, we could have balance transferred the B of A credit card to another card with a lower interest rate... but with his tactic of lowering our score, our chances of doing that are now greatly reduced.

He knew what he was doing to us - it's railroading and it's destructive. BEWARE! If you are trying to improve your situation and you call up and try work with Bank of America. They will probably go on a power trip and do something nasty to you too. It benefits them to put you in a bad position, make no mistake. America is being squeezed.

Damage Resulting: Damage to our credit rating. It will make it harder for us to negotiate our rates and payments down, which will make it harder for us to pay down our credit cards. His actions and his heavy-handedness also made me so angry that for the past 24 hours I have been unable to get on with things and unable to sleep.

He was trying to convince me that I was doomed and had no choice and I feel that his actions were retaliatory for my not going with his credit company. It isn't right to be treated this way by a creditor that you have been paying as agreed. And creditors should not be pimping for credit counseling services that ruin your credit.

Fraudulent Late Fees and Interest Levied on Undelivered Statements

WILMINGTON, DELAWARE -- I have held this credit card account since 2004 with the same address. I pay the balance due IN FULL every month. Approximately six months ago, just after the new regulations went into effect, I began to have issues with getting my statement. I noted that I had not received a statement and called their toll free customer service number. Upon verifying my address, I found that after 6 years of using that same address, they had somehow mysteriously had it wrong in their system.

As the bill was not due at that time, I had them correct the address, requested a copy of the statement and the amount due, went to the bank, and paid it IN FULL. The next few statements arrived and were paid IN FULL. Last month, 5/2010, I received a call from a B of A representative, two days after the March bill was due, informing me that both the February and March bills had gone unpaid.

Upon verifying my address, it was determined that B of A, once again, my address in their system had mysteriously been altered. The representative, once again, corrected the address, credited me for late charges in the amount of $78 for the 2 months, although I don't know if interest charges were credited because I have not received another statement since then.

I did, however, receive the two statements "ACCOMPANIED BY A LETTER STATING THAT THEY WERE PROVIDED EITHER AT MY REQUEST OR BECAUSE STATEMENTS HAD BEEN DAMAGED DURING THEIR PRINTING PROCESS" for February and March at that same address several days later. No mention was made of THEIR error. I have not received a statement since then.

This morning, realizing that I had not received a statement again, I called B of A "customer service" and was told they had the right address and that my statements had been mailed, and once again, the payment was overdue, but they could/would not reverse any late charges. They suggested I contact the post office but I have absolutely never had any problem receiving any Print Complaint Form.

3 of 5 6/27/2010 10:54 AM credit card statements or other mail at that address and B of A has screwed it up 3 times in six months, so arguably there is something wrong there. I asked for a supervisor and spoke with a ** who basically repeated the same thing again. When I told her I wanted to speak with a superior she said she could have someone call me back within 3 days.

When I asked her for some means of identifying her, she replied that none was available except her name was **, no transaction id, last name, or other means was to be provided to me. When I asked for a dispute form, she stated that it was on the back of the statement (which I hadn't received) and said I "couldn't dispute a late charge" using that form. When I asked how to dispute one, she said "with me".

After that it all gets rather circular. I find it highly suspicious that, as soon as the new credit card rules became mandatory, all of a sudden billing addresses have been mysteriously altered. Oddly, I regularly receive junk mail from B of A that address with no problem. I also find it highly suspicious that the only statement that has this difficulty is the one that gets PAID IN FULL every month. It's the bank's position that I should pay my bill regardless of any demand for payment, although my agreement with them clearly states that "charges will be billed".

Because the bank representative informed me that I have no recourse, refuses to identify anyone in authority to deal with or provide any verification that they have mailed the statements, I will be consulting with an attorney experienced in class action litigation with financial institutions to determine if there is a pattern of this kind of conduct and a certifiable class. It seems to me just another way for the institution to make money from people who manage their credit responsibly.

I have filed complaints with the Comptroller of the Currency at the Federal Reserve, and with the NC Attorney General's Office, and am seeking counsel with experience in Class Actions vs. Banks. If you have had a similar experience, feel free to contact me at ** at Yahoo.

Bank of America Did Not Take the Steps Necessary to Protect My Privacy and My Ex's Credit

PORT ANGELES, WASHINGTON -- 2 and a half years ago my ex husband and I became legally separated, we both went into Bank of America in Port Angeles WA, their 8th street branch and sat down with a banking specialist to pay off our joint Visa card and close our joint checking account.

At that time we did pay off our Visa and ** and I signed a paper to remove him from the Visa card and any responsibility that he may have towards any future debt. The woman had sad that I could keep my account open and in my name as well as the checking and savings account because it was an original account I had from when I was younger, opened in 1977 with a Savings account in my name.

I originally asked to keep the accounts open in my name only (with my ex husband sitting right beside me). For convenience sake I had payments on my Visa that came monthly like magazines, make up, etc. The banker said it would be fine and we both asked several times that he was no longer on the card or held any responsibility. The Banker assured us each time that he was no longer on the account nor responsible and could not access my Visa statements (that was one of my concerns). All was well...

Until I had some medical issues that were not covered by my insurance and I found myself struggling financially. I am a single Mom with three kids, two are my ex's, ages 13 & 15. My youngest is 15 months. I became behind in my credit card payments and tried to make a plan for repayment with the credit card company, but they wanted too much money a month and I couldn't do it. That is when they went after my ex husband.

So then not only was I dealing with the bank but a very angry ex husband who's credit score was being tampered with and he has now sent me a letter from a Collection lawyer with the intent to sue me...for the amount I owe the Visa Co. (it has now been bought by a junk debt collection agency)...

I enrolled myself into a Credit Solutions program in Jan and have been working with them to repay not only this debt but others as well including medical. To be hit with this new problem, I am just drowning and so embarrassed. I always had exceptional credit and am such a private person. My ex was allowed to get copies of my monthly statements over the last couple of years and has shared them with "friends" that he got in the divorce, hahaha!

It is such a mess. This is a private problem of mine one I was trying to take care of myself without worrying those I love. My Dad has terminal cancer and a tumor near his heart, word of this to him and it would devastate him. He tries so hard to be there for us all.

I have spoken with a lawyer well a few and none of them in my small town can I find to help me, the one and only one that keeps getting refereed to me is my ex-husbands lawyer. But they all have agreed that this issue is one that should be taken up with Bank of America not me and that I now have a case with them as well.

We both have tried to talk with Bank of America. (My ex cannot locate the copy of the paper work he signed) and have gotten no where. When I asked for paper work from them like a copy of the original application I was told it would be sent to me, but all I received was a paper saying the item I requested could not be located. And when I asked why he was not removed from the Visa account they said because he was not approved to be removed. That is nothing that was told to us at the time or I would have never asked to keep the account and he would never have agreed to it.

I do not have the finances to go after Bank of America myself or to be sued by my ex who has taken the law into his own hands and ceased paying me maintenance & is threatening to put a lien on my home and make me pay his court costs...the letter states that I wrongfully used a credit card in his name. I never knew that he was not removed. I did not wrongfully do anything. I had no ill intent.

I had no reason to believe Bank of America did not do what they said they would. The Banking specialist assured me that he was off the card as of that day. He said that I could go out and use it that moment and he was no longer responsible. I hope you can help me or point me in a direction of help. Thank you so much for your time reading this.

Where do I begin? My husband and I have great credit. We pay our mortgage a month early. We pay the balance of our credit cards every month and before the due date! We have no debt as of this moment. BUT we are in our early sixties and we are selling our home which we renovated and maintain it in superior condition.

We've always been conservative in our investments but like so many other American were blind sighted by some economic surprises thus found ourselves caught in a financial crunch! So we go to our bank that has been happy to have our business/money for quite a while. They were so happy to have our business that they give us private banking (customer service) "privileges"!

So we go to our special banker BUT their "private premier bankers" are no longer there which they did NOT alert us to. We need assistance to get us over this temporary patch till we sell our home. We are REJECTED! Nothing! Nada! Our super great credit and excellent financial record MEANS NOTHING!

AGAIN, we are in our sixties and both have worked very hard all our lives and have paid our bills, our taxes, and have donated to the community throughout. So needless to say there is more going out than coming in and our biggest investment that we put so much of our sweat into means NOTHING!

SOOOO we need some cash and have, through Bank of America MasterCard and AMEX a large line of credit. For years they reminded us that if ever we need a cash transfer from either one of these credit cards into our bank, we have the credit to do so.

So we call to do just that. We are told that they lowered that line of credit the day before. I say "okay, how much is that line." They lowered it by half. With that I then request a cash transfer of half of that amount. They apologize but it "LOOKS" as if they can not do that. They refuse to transfer any money from these credit cards to our checking and will not explain why!!!

MY GOD ALMIGHTY! I KNOW WE ARE NOT ALONE IN THIS! Was it not WE THE PEOPLE who bailed out these banks with OUR money? And is it not these very same GREEDY banks that are obviously HOARDING our money? Wouldn't this economy be improving at a faster pace if these BANKS were in turn, helping bail out Americans with sensible loans???

I voted for President Obama. I understand we are in the MESS we are in because of previous administrations and previous generations for such shortsightedness and GREED. But please... someone explain to me WHY, WHY, WHY we are not holding these banks accountable and responsible now? Most of us do NOT have 3-5 years to wait for money to start flowing. WHY do we not make this BANKING PROBLEM OUR PRIORITY?

My husband and I did not take big risks with our money. We have paid off every debt we ever had and up till now have maintained a balance of 0 on our credit cards. Our credit report reflects all this and yet... I'm sorry but the word that comes to mind is....**! I usually do not resort to expletives but what the hell!

Bank of America, you and your credit cards companies are no better than loan sharks! You are unethical, unconscionable, you are criminal, and you are immoral! People are angry and understandably so. Not only angry with this economic fiasco but also angry and sad with experiencing such an overwhelming feeling of helplessness and hopelessness!

President Obama, representatives and senators, address this issue with the banks NOW. If the banks start lending NOW, our economy will improve NOW! PLEASE, someone tell me where else and/or who else do I go to to lodge this complaint. How do I do this MOST EFFECTIVELY?

Bank of America Untrustworthy

I have always paid my bills, paid more than the minimum, and paid on time. A year ago, Bank of America tried to up my interest rate for no reason. They even went so far as to try to tell me they had assessed my credit-worthiness and felt I had no other choice but go along with the increase. Wow that made me mad. So I balance transferred them and left the card at zero.

Then, in late February 09, they sent me an offer in the mail for a rate of 3.99% for 6 months, for any charges made that posted through March 10 2009. There was one thing I had planned to charge, although I had originally planned to charge it on another line of credit. But with this offer and against my better judgment, I went ahead and used my old B of A card to get that rate.

At the beginning of April, I called B of A to check my balance and was told my rate for this purchase was over 20%! When I protested they said "Oh, that 3.99% promotional rate expired on March 31st." But that wasn't what the offer they sent me said! So they changed the deal once I had made the charge. Unbelievable! They wouldn't put the rate back, of course. In my book this is fraud.

Oh and BEWARE... Bank of America now apparently calls people up offering credit life insurance, but what they then do is attempt to find out personal information. They were asking me if I was still employed, etc. Well, I resent this very much. It's none of their business. I pay my bills. I think they are just collecting information.

We gave these people billions of our taxpayer money because we were told that the banks were on the "verge of collapse". Then with the money in hand, they whine about restrictions on frivolously spending it. I have read now that they (Bank of America being one of the worst) have leveraged OUR real estate, OUR homes, dozens of times over, putting us all terribly at risk.

Now to add insult to injury, Bank of America and JP Morgan Chase are upping our fees and interest rates to insane amounts and trying to tell us it's because WE can't be TRUSTED to pay our bills, even though WE ARE paying our bills. The truth is, THEY are the ones who cannot be trusted, and they know it.

It no longer matters what the truth is, see. It's a flimsy excuse to take money that YOU didn't agree to pay, and it amounts to financial rape. Then to justify it, they tell you it's something wrong with YOU, try to make you feel like you aren't good enough to avoid being penalized. But actually, they are stealing us blind at a time when we are in a weakened state. We cannot afford this.

Don't believe any offers they make, Bank of America cannot be trusted. Their fine print will admit that they will change any offer they make at moments notice. In my opinion, America needs to wake up and realize they are not on our side, they are not one of us, and they are hurting our society.

Raising Rates On My Credit Card

I am extremely frustrated with the companies that have been the recipients of bail out money taking advantage of the financial situation today. My family and I returned yesterday from a week long vacation. I was going through the mail and found a notice from Bank of America regarding one of my current credit card accounts. I do have two credit cards with Bank of America, one was originally an MBNA card but had become BofA after they purchased MBNA, and this card was the card the notice was intended.

I had a very good interest rate on the card and yes, unfortunately I was carrying a balance on the card, like most Americans do these days. The notice was informing me that the interest rate along with numerous other items were being modified. But, the gist of the notice was my good interest rate 9.99% was going to be "modified". This obviously meant "increased". The notice did give me the option to reject the rate adjustment but the following stipulation was part of the rejection: After rejection I could not use the card for any other purchases and if there was a purchase the rate would be immediately adjusted. If any payment was late the rate would be adjusted.

I obviously chose to reject the rate modification. Upon further thought, as well as increased frustration, I called Bank of America and requested to have the card of interest as well as my original BofA credit card accounts closed. I was told that this may hurt my credit but instructed them to continue to close both accounts. I asked that my following comment be recorded as well: "I have been a good customer in good standing with both credit cards. I have closed my credit card accounts with Band of America and will never do business with Bank of America again."

I think this is outrageous. BofA has taken government money (my tax dollars) and has not done anything to help the average American reduce debt. Instead, they have taken the money and now are increasing credit card interest rates. This now makes it harder to get out of debt and makes BofA more profitable. Yes, I did borrow BofA money and I have every intention of paying that money back. But to take bailout money and turn around and jack interest rates. They are basically double dipping. They are getting my money on the front and back ends. This is awful.

Shouldn't they be doing things to help their customers now that they have accepted government money? I would think if they cut my rates then that would help me to reduce the amount owed and then I would also have more money to spend elsewhere. This would in turn help stimulate the economy. Instead, they raise the rates of customers who make their payments with the intentions of keeping them indebted to BofA. On second thought, they probably target people/consumers like me, as this means a constant source of income for them.

I am probably doing what is not needed to help the economy recover. My family, an engineer, a teacher, and three kids, are going to cut way back on spending in order to pay off BofA in as short of time as possible in order to reduce the amount of money that we pay them. I will start looking for a part-time job in order to help pay off the two credit cards as quickly as possible. It just doesn't seem right that this bank has the word "America" in its name, or does it?

I am SO pissed I am vibrating right now. Seems that when I called Bank of America on March 19th about their debt consolidation loan mailer (and was of course turned down as you NEVER get the rate the offer is for with them) they took it upon themselves to close both of the cards I have with them. Of course they did not see fit to tell me or send back the overpayment of $91.90 still setting in my account. In fact they just sent me checks to use to transfer money at 3.99% onto a card and their website shows both cards as still active!

After having the card declined I called customer support which told me the account I was calling about was closed and asked if I'd like a check sent with the money they owed me. I asked why they had not done that already and he said "we hang onto it till you ask for it." BTW per my quarterly report from Discover my credit score as of March 10th was 777.

One card had a $20500 limit and the other $17000. One can only imagine how they treat people with average credit. I also have cards with Discover, AmEx, Capital One, Household and 3 with Chase after mergers and I am not seeing this nonsense with them. Though Cap One has other privacy issues (they gave my number to collection agencies looking for my ex-wife).

BOA is the same company that screwed me on a promotion last year. I transferred a balance onto one of their cards and signed up for e-statements. I setup automatic payments with my bank and forgot about it. Well they changed the due date so the first payment was 2 days late and raised my rate from 0% to 21%.

As it seems that the email address I gave had issues AND oddly their Quicken interface seemed to fail about this time, AGAIN, it set there for a few months before I noticed Quicken was no longer getting data from them. By then I had racked up over $1000 in interest charges. At that point I transferred the balance to Chase. Note they did not bother sending a letter that the email account was not working till later.

Before that I let them sign me up for a trial credit monitoring/protection service to compare it against Discovers service. I never heard ONE word from them and so I completely forgot about it. A year later they charged my account. Since I had not used the card in 3 months I did not look at that statement. And of course it is not updating Quicken AGAIN, though since I have not charged anything that would seem right.

Anyway the next month I happen to check the statement and I see a late fee on it and call them up. It takes awhile for them to even route me to the right place to cancel this useless service. AND it will take them a few weeks more to reverse the charge. In the meantime I need to pay the $99 charge PLUS $46.25 in fees and interest to avoid another late fee AND ANOTHER nonpayment mark on my credit history! Note for the same cost, Discover's service sends me a quarterly summary AND a notice EVERY TIME someone queries my credit. This BOA partner could not even be bothered to let me know the service had started.

BOA was supposed to do my final mortgage on the house I just built but I think I would go with even Citi Bank over them at this point. They did raise my purchase rate too but then all the cards are doing that these days. It is getting cheaper to get money from the mob than carry a balance on your cards.

Bank of American is killing my father!

My parents have NEVER been late on a payment in their lives. They have excellent credit and Bank of America is going to ruin all they've worked so hard for. My father retired about 9 years ago and was screwed by the "Financial Advisor" that was supposed to take care of them. He was able to not work for about a year but had to go back to work because he didn't have any money left from his retirement to live on any longer. This alone was very hard on him.

Now he's been working for almost 8 years making less than half of what he was making at the job he retired from and when they completely ran out of money from his retirement account, my husband and myself said we would do what we could to help them. We have our own small business and at first it was not a problem but all things change, just as our economy has changed.

This week my mom received her Bank of America credit card statement and her interest rate went from 1.99% to 19.99%. Her interest payment is more now than her total payment was before. The payment has doubled and there is NO WAY they can make this payment. I immediately call Bank of America, reminded them that there has NEVER been a late payment and that the credit score was perfect and I said if you want to continue to receive a payment you will leave the interest rate as it was.

Their response was, we can't do that! (Or we WON'T do that). They can do a pymt. arrangement but it will affect the credit negatively. I said, “Why would we continue to send you any money if it's going to affect the credit score negatively when if you never receive another payment, it's negative also?” I asked to talk to the person that makes the decisions. Was transferred to the Credit Dept. and again was told that they can't offer a lower interest rate.

They again transferred the call to a credit counseling company. I've been told from a lawyer friend that credit counseling is just as bad as a bankruptcy. I didn't give them any personal information. I asked if it would affect their credit score and he said NO. This is not true!

Also, you would NEVER, EVER get this paid off. Bank of America is not going to lower your interest rate. They are accepting lower payments from the credit counseling company which isn't even paying your interest which continues to add up along with the principal which you are never touching. So this will be a payment for the REST OF YOUR LIFE!

I told my parents they need to stop making the payments (they have nothing that Bank of America wants, if you know what I mean) their house is paid for which they are going to "sell to me" so it can't be touched by any credit card company! What can they do? They are a year from my dad collecting Social Security. They won't be borrowing money in the future. If for some reason they need something, my husband and I will take care of it if we can.

I believe that Bank of America and the other credit card companies are trying to get what they can from the people making their payments by sky rocketing their interest rate for NO REASON to make up for all the people or aren't or can't make their payments. There is no reason that Bank of America can't work with my family. My dad feels like this is HIS debt, he agreed to pay back this money and he wants to do what he can to do that.

(Bankruptcy, to him is not an option). The thought of working all his life, "doing the right thing" keeping his credit spotless all these years and at age 64 all of this work will be for NOTHING, is just making him sick. The stress is more than he can handle. I worry about his health everyday.

I've done what I know to do. We've tried applying for other lower interest rate cards to pay off BOA but the balance is to high too get this done. I wish Bank of America and all its rich, greedy executives would loose everything just like what's happening to my parents. I believe it's only a matter of time...

Yesterday, 2/25/09, I called Bank of America to do a balance transfer from my credit card to my checking account in the amount of $2000. The representative said my account was closed due to me being a “risk” because Foreclosure was listed on my credit report.

First, let me note that I had no notice of Bank of America closing my credit card account, not by mail or by phone so this was a shock at best to find out when I needed my Bank of America credit card the most important time in my life, it was not accessible to me.

I explained to her this must have been an error because I sold my house on 1/20/09, I have never been late or missed a Bank of America credit card payment in the entire 10 years of holding the card. She looked at some things and said she was sorry there was nothing more she could do for me. She then transferred me to the credit department so someone higher up could speak with me. He said due to a foreclosure being reported on my credit report I became a “risk” and they therefore had to close my account.

$4000 in a mortgage payment and utility bills is a lot harder to come up with than $197 a month Bank of America credit card payment first of all. Secondly, I had no notice of this about to happen by paper or phone call. Thirdly, I had never been late or missed a payment with Bank of America. I could see if I became delinquent with them but they just shut down my account because they “assumed” I would “become” delinquent in my credit card account?

What give them the right to determine what I “would do” with my accounts? I am extremely upset about this as well as thinking this whole thing is just morally wrong. How in the world do they expect the mortgage crisis to get better if they take away what may be the only way people have a way to pay their mortgages until they find a job? Do they think the people that lost their jobs will never get another job and will never pay another bill in their life to regain valid credit status?

I then called Citimortgage and asked them what it was listed as and they said the Foreclosure proceedings started 1/4/09 and we sold the house 1/20/09 so the error was being corrected with the credit bureaus immediately. I then called back Bank of American explaining all of this and a representative told me to fax the letter of sale from Citimortgage to a fax number she gave me at the credit department at Bank of America so they could re-open my account. As I said before, I called this morning and my account has NOT been re-opened.

I called back to see if they received my fax and the representative said it was a first come first serve basis but they would call me as soon as they got to it. That was yesterday, I have yet to receive a call as of yet and I called the credit department twice this morning. I will be closing ALL of my Bank of America accounts, credit card, checking, debit and any savings account I was “thinking” of opening and will be taking my business elsewhere. I am also going to let as many people who would be interested in this story know about what happened to me and why.

Yes, I did a short sale and I did not Foreclose, but what if I HAD Foreclosed, because obviously, if I did, which is what it's listed as and I was told by several people in higher authority at Bank of America that it is why it happened, if I HAD Foreclosed, my credit account would be closed, no notification, no lateness or missed payments, I find this appalling.

They Won't Give My Money Back--And They're Giving Me The Runaround

I overpaid my credit card in October $1550. Like a dope when I discovered the overpayment, I called up and asked that what was left, $816.96, be returned to my checking account. The man I talked to said that would happen right away. Three to four days later, I called again because nothing had happened. That person said that it would take about 3-4 business days to make it happen. A week later, I called again; this time this person said it would take 7-10 days to make it happen, i. e., reversing the payment into my checking account (this part is important).

A week later, nothing had happened. So, I called again. This man said that it was a problem with money laundering, and it had to go through a series of processes—which was why it was taking so long—and would be complete in 10 days to a month. He assured me that, yes, the money was in process, and that Check Free (or something like that he muttered) was handling the procedure—that was in response to my request to cancel the whole transaction. I was content with the money laundering story—if that was what was going on, I could understand the delay. I got a letter from BOFA that said the money would be in my account in 10 days to one month.

When we got to the one month point, which was just before Thanksgiving, I called again. This time, I asked to talk to a supervisor, who said that, yes, it was in process, and yes, it was strange that the money had not been credited to my account, and he would request a rush to find out what was going on and for me to call back in a few days. He also notated that I knew about the money laundering and that there was a strange delay in the return of the money to my checking account.

Then I got a letter generated on 12/1/08, and here is the text: "You recently requested a refund of the credit balance on the above-referenced account to bring the account balance to zero. A review of your account indicates that it does not currently have a credit balance… Subsequent transactions or fees may have been applied to the account, eliminating the credit balance."

At this point, I saw red (yet again) because, clearly, these yoyos were getting SOMETHING WRONG. My account does not have a credit balance—but it would have had a zero balance if the $816.96 had been credited to my account (and the balance paid off, which is what I normally do)! All I WANTED TO FIND OUT WAS WHERE WAS THE MONEY BEING CREDITED TO MY CHECKING ACCOUNT.

So I called, yet again. This time, a representative from LA informed me that a CHECK had been cut for me and sent out (supposedly), and that NO ONE HAD DONE A DAMN THING other than telling me to wait because they expected the check to arrive. I told her that, no, I was told the money was going directly into my checking account. She said, no, they had cut me a check. This was the FIRST TIME anyone mentioned a CHECK!

After a consultation with her supervisor, the representative advised me to withdraw the money from my credit card as a cash advance, and she would handle the fees. She would also stop payment on the check. Oh, and as for the money laundering story, she said that would be for over $7,000, but for my account, it was NONSENSE!!! The Rep said she would reverse the cash withdrawal charges and call me in two days.

So I took out the money, $816.96, and put it back in. (Somewhere in there it occurred to me that if she cancelled the check, the money would be automatically credited to my account—but you know how crazy things get). Guess what? No fees were reversed. The representative did NOT call me two days later. I STILL have a $816.96 balance.

So I called again on 12/15, and a representative in Phoenix insisted that a payment was made on 12/9 of $816.96. Of course it was! It's what I took out as a cash advance to handle this whole mess. She said the refund would be made within 10 days.

On January 12, 2009, the Customer Satisfaction department sent me a letter that said that you “transferred the amount of $816.96 back to the originating source. The adjustment appeared on your monthly statement. Please contact your online bill payer service for further assistance.”

NOT SO FAST. I have ALL my statements from my checking account (WAMU) and THERE ARE NO CREDITS BACK TO MY ACCOUNT. And, if you'll recall (#8) the LA representative said there was no credit back to my account, but a CHECK. (I'll be more than glad to provide ALL my statements since October showing there was NO chargeback).

I called on 1-23-09 and talked to **. He kept trying to convince me that the money had gone back to my checking account on 10/23; when he figured out what was going on after much discussion. He said he was going to have the whole thing researched and someone would get back to me within 3-5 days. On 2/20/09, I received another letter from Customer Satisfaction, saying the same damn thing they said before.

THEY DIDN'T READ THE NOTES! At this point, this whole farrago has gone into surreality. As you can tell from this long narrative, I am DEEPLY upset. Not only have I continued to get the runaround from BOFA, they have lied to me, shown great incompetence, and been completely inefficient.
